2. Subscriptions and Automatic Renewal Subscriptions are billed annually in advance. Your subscription will automatically renew each year on your renewal date unless you cancel before the renewal date. We will send you a reminder email at least 30 days before your subscription renews. You authorize us to charge your payment method on file for each renewal.
3. Cancellation You may cancel your subscription at any time through your account dashboard or by contacting us. Cancellations take effect at the end of the current billing period. No partial refunds will be issued for the current subscription term.
4. Gift Selection and Delivery You will receive an email with gift options approximately 30 days before your anniversary. If you do not make a selection, we will automatically send a gift. Gifts will be delivered 2–5 days before the anniversary date. Flowers will be delivered 1–2 days before the anniversary date. We are not responsible for gifts sent to incorrect addresses or with incorrect information you provide.
5. Pricing and Payment All fees are shown on our website and are subject to change with reasonable notice. Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for all applicable fees. All sales are final except where required by law.
6. Refunds Refunds are provided only in accordance with our cancellation policy or where required by applicable law.
7. User Responsibilities You are responsible for providing accurate anniversary dates and shipping addresses. We are not liable for missed or incorrect deliveries resulting from information you provide.
8. Intellectual Property All content on our website and service, including text, graphics, logos, images, and software, is owned by or licensed to Effortless Gifts. You may not copy, modify, distribute, or create derivative works from our content without our prior written permission.
9. Prohibited Uses You may not use our service for any illegal purpose or in a way that violates these Terms. We reserve the right to suspend or terminate accounts that violate these Terms.
10. Limitation of Liability To the fullest extent permitted by law, Effortless Gifts’ total liability to you shall not exceed the total amount you paid us in the 12 months preceding any claim. We are not liable for indirect, incidental, special, or consequential damages.

The arbitration shall take place in Texas. The arbitrator’s decision shall be final and binding.
13. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. However, if you are a resident of California or another state with consumer protection laws that provide greater rights, those laws will apply to the extent they conflict with these Terms.
